Packaging compliance is a separate workstream from product quality and textile labelling. For goods sold in Germany, importers and producers should check their obligations under the German packaging framework, the LUCID Packaging Register and the EU Packaging and Packaging Waste Regulation (PPWR), Regulation (EU) 2025/40. The PPWR entered into force in 2025 and has applied since 12 August 2026.
The correct party depends on the supply-chain role, packaging type, sales channel and whether a business sells directly to end users. This guide highlights the 2026 position and does not determine which company is the statutory producer for a particular transaction.
1. Identify the packaging and the statutory producer
List all packaging placed on the German market: retail boxes, polybags, sleeves, inserts, shipping cartons, protective wrap and transport packaging. Record the packaging material, weight, packaging level, intended customer and who first places the packaged product on the German market. Do not assume that the Indian manufacturer is always the responsible producer or that the German importer is always responsible; the legal definition and transaction structure must be checked.
2. LUCID registration and packaging system participation
Where a company qualifies as a producer under the German packaging rules, it may need to register in the LUCID Packaging Register and meet the applicable system participation and reporting obligations for packaging subject to those requirements. LUCID registration is free. Registration and system participation are distinct steps: completing one does not automatically satisfy the other.
The producer should keep master data, packaging categories and quantities accurate and up to date. The company should also confirm whether it must report packaging volumes to its system operator and LUCID, and reconcile the figures to the records used for sales and imports.
3. Important 2026 change for foreign companies selling directly to end users
From 12 August 2026, a company based outside Germany, without a branch in Germany, that sells empty packaging or packaged products directly to end consumers in Germany is required to appoint an authorised representative for the relevant extended producer responsibility obligations. The representative must be recorded in LUCID as required by the German authority.
The Central Agency Packaging Register states that LUCID registration itself remains the producer’s personal duty and cannot simply be delegated to the authorised representative. This change is particularly important for foreign direct-to-consumer sellers. A business exporting B2B to a German importer should separately establish which party is the statutory producer in that supply chain.
4. Understand the PPWR transition
The PPWR establishes EU-wide packaging rules covering packaging design, composition, recyclability, waste prevention, reuse and producer responsibility. It applies from 12 August 2026, although individual provisions contain their own transition dates, delegated acts or later application dates. Do not treat the application date as meaning that every packaging requirement became mandatory in exactly the same way on that day.
Germany has also introduced implementing arrangements under the VerpackDG. German producers and foreign direct sellers should review the current LUCID instructions and official implementation guidance rather than rely on older packaging-law checklists written before August 2026.
5. What an importer should request from an Indian supplier
- Packaging bill of materials by SKU and packaging level.
- Material identification and weights for each packaging component.
- Packaging drawings, dimensions and units per carton.
- Records for changes to packaging materials or suppliers.
- Accurate shipping and product data to support the importer’s quantity reporting.
- Confirmation of who is responsible for EPR registration, system participation and reporting in Germany.
6. Keep product and packaging compliance separate
A product can meet its safety and textile labelling requirements while its packaging obligations remain incomplete. Conversely, a LUCID number does not demonstrate that a product itself complies with product safety, REACH or textile composition rules. Maintain separate compliance records and identify the accountable entity for each obligation.
How Vanguard Sourcing can support packaging data collection
Within an agreed scope, Vanguard Sourcing can request packaging specifications and weights from Indian suppliers, coordinate packaging revisions and maintain product/packaging records for the buyer. The German producer or importer must determine the statutory role, register where required, appoint any authorised representative and complete EPR reporting and system participation.
